1. Introduction

This website is operated by: Eileen Fibranz-Striesel.

It is very important to us to handle the data of our website visitors confidentially and to protect it as best as possible. For this reason, we make every effort to comply with the requirements of the GDPR.

Below, we explain how we process your data on our website. We use clear and transparent language so that you can truly understand what happens to your data.

2. General Information

2.1 Processing of Personal Data and Other Terms

Data protection applies when processing personal data. Personal data refers to all information that can be used to identify you personally. For example, this includes the IP address of the device (PC, laptop, smartphone, etc.) you are currently using. Such data is processed when “something happens with it.” For instance, the IP address is transmitted from the browser to our provider and stored automatically. This is then a processing of personal data (according to Art. 4 No. 2 GDPR) (according to Art. 4 No. 1 GDPR).

These and other legal definitions can be found in Art. 4 GDPR.

2.2 Applicable Regulations/Laws – GDPR, BDSG, and TDDDG

The scope of data protection is regulated by laws. In this case, these are the GDPR (General Data Protection Regulation) as a European regulation and the BDSG (Federal Data Protection Act) as national law.

Furthermore, the TDDDG complements the provisions of the GDPR regarding the use of cookies.

2.3 The Data Controller

The entity responsible for data processing on this website is the data controller as defined by the GDPR. This is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data.

You can contact the data controller at:

Eileen Fibranz-Striesel
c/o IP-Management #17545
Ludwig-Erhard-Str. 18
20459 Hamburg
kontakt@lovestorycontent.de

2.4 General Data Processing on This Website

As we have already established, there is data (e.g., IP address) that is collected automatically. This data is primarily needed for the technical provision of the website. If we use personal data or collect other data beyond this, we will inform you or ask for your consent.

Other personal data is provided by you consciously.

You will find detailed information on this further below.

2.5 Your Rights

The GDPR grants you comprehensive rights. These include, for example, the free right to information about the origin, recipients, and purpose of your stored personal data. You can also request the correction, blocking, or deletion of this data or lodge a complaint with the relevant data protection supervisory authority. You can withdraw your consent at any time.

Details on how these rights look and how to exercise them can be found in the last section of this privacy policy.

2.6 Data Protection – Our Perspective

Data protection is more than just a tedious obligation for us! Personal data has great value, and careful handling of this data should be a matter of course in our digitalized world. Furthermore, as a website visitor, you should be able to decide for yourself what, when, and by whom happens with your data. Therefore, we commit to complying with all legal requirements, only collecting the necessary data, and treating it confidentially.

2.7 Data Transfer and Deletion

The transfer and deletion of data are also important and sensitive topics. Therefore, we would like to briefly inform you about our general approach to this matter.

Data will only be shared based on a legal basis and only when it is unavoidable. This may be the case, in particular, when it involves a so-called processor and a processing contract has been concluded according to Art. 28 GDPR.

We will delete your data when the purpose and legal basis for processing cease to exist and there are no other legal obligations preventing deletion. A ‘good’ overview of this is also provided by Art. 17 GDPR.

For all further information, please refer to this privacy policy and contact the data controller for specific questions.

2.8 Hosting

This website is hosted externally. The personal data collected on this website is stored on the servers of the host. This includes the automatically collected and stored log files (see below for details), as well as all other data that website visitors provide.

The external hosting is done for the purpose of securely, quickly, and reliably providing our website and serves in this context to fulfill our contract with potential and existing customers.

The legal basis for processing is Art. 6 para. 1 lit. a, b, and f GDPR, as well as § 25 para. 1 TDDDG, insofar as consent includes the storage of cookies or access to information on the device of the website visitor or user within the meaning of the TDDDG.

Our host only processes data that is necessary to fulfill its service obligations and acts as our processor, meaning it is subject to our instructions. We have concluded a corresponding contract on data processing with our host.

We use the following host:

WiX
Wix.com Ltd., Nemal St. 40, 6350671 Tel Aviv, Israel.
support@wix.com

2.9 Legal Bases

The processing of personal data always requires a legal basis. The GDPR provides the following options in Art. 6 para. 1 sentence 1:

b) The processing is necessary for the performance of a contract to which the data subject is a party, or to take steps at the request of the data subject prior to entering into a contract;

c) The processing is necessary for compliance with a legal obligation to which the controller is subject;

d) The processing is necessary to protect the vital interests of the data subject or another natural person;

e) The processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;

f) The processing is necessary for the purposes of the legitimate interests pursued by the controller or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject, which require protection of personal data, particularly if the data subject is a child.

In the following sections, we will provide you with the specific legal basis for each type of processing.

4. Other Important Information

In conclusion, we would like to inform you in detail about your rights and how you will be notified of changes to data protection requirements.

4.1 Your Rights in Detail

4.1.1 Right of Access under Article 15 GDPR

You have the right to request information about whether personal data concerning you is being processed. If that is the case, you can request further information about the nature of the processing. A detailed list can be found in Article 15(1)(a) to (h) of the GDPR.

4.1.2 Right to Rectification under Article 16 GDPR

This right includes the correction of inaccurate data and the completion of incomplete personal data.

4.1.3 Right to Erasure under Article 17 GDPR

This so-called "right to be forgotten" gives you the right to request the deletion of personal data by the controller under certain conditions. This is generally the case when the purpose of data processing has ceased, when consent has been withdrawn, or when the initial processing took place without a legal basis. A detailed list of reasons can be found in Article 17(1)(a) to (f) of the GDPR. This "right to be forgotten" also corresponds with the obligation of the controller under Article 17(2) of the GDPR to take appropriate measures to ensure a general deletion of the data.

4.1.4 Right to Restriction of Processing under Article 18 GDPR

This right is subject to the conditions outlined in Article 18(1)(a) to (d).

4.1.5 Right to Data Portability under Article 20 GDPR

This establishes the fundamental right to receive your own data in a commonly used format and to transmit it to another controller. However, this only applies to data processed based on consent or contract according to Article 20(1)(a) and (b), and only to the extent that this is technically feasible.

4.1.6 Right to Object under Article 21 GDPR

You generally have the right to object to the processing of your personal data. This applies particularly when your interest in the objection outweighs the legitimate interest of the controller in processing, and if the processing relates to direct marketing and/or profiling.

4.1.7 Right to "Individual Decision" under Article 22 GDPR

You have the right not to be subjected to a decision based solely on automated processing (including profiling) that has legal effects on you or similarly significantly affects you. However, this right is also subject to limitations and supplements under Article 22(2) and (4) of the GDPR.

4.1.8 Additional Rights

The GDPR includes comprehensive rights regarding informing third parties about whether or how you have asserted rights under Articles 16, 17, and 18 GDPR. This is only applicable to the extent that it is possible or can be carried out with reasonable effort.

We would like to remind you again of your right to withdraw consent given under Article 7(3) GDPR. However, the lawfulness of the processing carried out until that point is not affected.

We would also like to draw your attention to your rights under Sections 32 et seq. of the Federal Data Protection Act (BDSG), which are largely consistent with the rights just described.

4.1.9 Right to Lodge a Complaint under Article 77 GDPR

You also have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your personal data concerning you violates this regulation.

5. What if the GDPR is abolished tomorrow or other changes occur?

The current version of this privacy policy is dated October 21, 2024. From time to time, it may be necessary to adjust the content of the privacy policy in response to actual and legal changes.
